Clear terms for a digital family keepsake.

1. Service description

Moonwish is an online service for creating personalized digital storybooks. A user may personalize an authored template (Choose a Story) or provide an idea for an original book (Create Your Own). Outputs may include story text, illustrations, narration, downloads, and optional sharing features. Unless a separate product explicitly says otherwise, Moonwish sells digital delivery only and no physical goods are included.

2. Eligibility and account use

You must be legally able to accept these Terms. A child should use Moonwish only with a parent or guardian. You are responsible for your account, credentials, submissions, and anyone using your account. Do not impersonate another person, share access in a way that defeats account limits, or create accounts to evade moderation or free-preview limits.

3. The free character preview and paid book credits

• While the free preview is offered, each eligible account can use one free character preview: a single character portrait of the child, generated from an authorized photo. The preview may be limited to some accounts or by a daily limit.
• A character preview is not a complete book and is not a finished story illustration. A complete eight-page book always requires a book credit, for both Choose a Story and Create Your Own.
• The free preview is not renewed after it is used.
• Purchased book credits do not expire.
• One credit creates one eligible digital storybook in the product category shown at purchase.
• Credits are account-bound, have no cash value, and may not be resold or transferred unless Moonwish expressly allows it.

Current prices are published on the public Pricing page. Moonwish may change future prices or packs, but a price change does not remove already purchased, unused credits.

4. Payment

When paid checkout is available, the checkout page will show the total price and currency before confirmation. Payments are processed by the identified payment provider under its own terms. Paid credits are added only after successful payment confirmation. Taxes or other required charges may be added where applicable and shown before payment.

5. Digital delivery

Delivery occurs online to the account and generation session used for the order. Generation may take time and may complete page by page. You are responsible for reviewing the result and saving any offered download before deleting account or local data. Public share links are optional and are not private merely because they are not indexed by search engines.

6. Refund policy

Moonwish sells a personalized digital book that is generated for one child after the order is placed. The rules below say exactly when a refund applies. To request one, email marson.mhs@gmail.com from the account address with the order reference.

1. Not started yet. If generation has not begun, the order is refunded in full on request.
2. Generation failed. If automatic generation fails, Moonwish restores the book credit so the book can be created again, or refunds the order in full if you prefer. A failed attempt never silently consumes a credit.
3. Serious delivery defect. If a delivered book has a serious defect — missing pages, a clearly wrong main character, pages that cannot be read, or a book that cannot be downloaded — Moonwish repairs it first. If it cannot reasonably be repaired, the order is refunded.
4. Completed and delivered as ordered. A personalized digital book that was generated and delivered as ordered is not refundable for subjective preference alone, because it is made for one child and cannot be resold. Consumer rights that applicable law grants you are unaffected.
5. Duplicate charge. A duplicate or repeated charge is refunded once verified.
6. When to ask. Please raise a request within 7 days of the purchase, while the generation records are still available. This is guidance, not a limit on any right the law gives you: a later request is still reviewed under applicable law and on the facts of your order.
7. How the money moves. Approved refunds are issued through Creem, the payment provider that processed the order, back to the original payment channel. When the money lands is determined by the payment institutions involved, not by Moonwish.

6b. 退款政策（中文）

Moonwish 售出的是下单后为某一个孩子单独生成的个性化数字绘本。以下规则说明退款适用的情形。 申请退款请用账户邮箱发送邮件至 marson.mhs@gmail.com，并附上订单编号。

1. 尚未开始制作。如果绘本尚未开始生成，提出申请即全额退款。
2. 自动生成失败。自动生成失败时，Moonwish 会恢复你的绘本额度， 让这本绘本可以重新生成；如果你更希望退款，也可以全额退款。失败的尝试不会悄悄扣掉额度。
3. 严重交付缺陷。已交付的绘本若存在严重缺陷——缺页、主角明显错误、 无法阅读或无法下载——我们优先提供修复；无法合理修复的，可以退款。
4. 已按订单正常完成并交付。已按订单生成并交付的个性化数字绘本， 不因单纯主观喜好当然退款，因为它只为一个孩子制作、无法再次售出。 这不影响适用法律赋予你的消费者权利。
5. 重复扣款。重复或多次扣款，经核实后退还。
6. 建议的申请时间。建议在购买后 7 天内提出售后申请， 以便生成记录仍然可查。这是建议而非对法定权利的限制：超过 7 天的申请， 我们仍会依据适用法律及你订单的实际情况审核。
7. 退款如何到账。通过审核的退款由处理该笔订单的支付服务商 Creem 退回原支付渠道；到账时间以支付机构为准，不由 Moonwish 决定。

7. Acceptable use

You must follow the Acceptable Use Policy. Moonwish prohibits adult sexual, sexually explicit, pornographic, NSFW, and graphic sexual content; nudity intended for sexual purposes; sexual content involving minors; sexualized depictions of minors; exploitative or abusive child content; illegal content; and attempts to bypass moderation.

8. Child and family photo consent

You may upload a photo only if you are the person pictured, the child’s parent or legal guardian, or an adult with clear authorization from the person or guardian. You must not upload sexualized child imagery, exploitative or abusive material, private intimate imagery, or content that misuses another person’s identity. Content may be rejected automatically and violating accounts may be blocked.

9. Intellectual property

You retain rights you already hold in content you submit. You grant Moonwish the limited permission needed to host, process, moderate, generate, deliver, store, and—only when you choose—share that content. You must have the rights and permissions required for every submission.

Moonwish’s service, brand, authored templates, interface, and underlying software remain protected by their applicable rights and licenses. Your rights in AI-generated output can vary by jurisdiction and provider; no exclusive copyright or non-infringement guarantee is made.

10. AI-generated content limitations

AI output may be inaccurate, inconsistent, incomplete, or unexpectedly similar to other material. Review every page before sharing it with a child or publishing it. Moonwish does not provide medical, legal, educational, psychological, or safety advice, and the service must not be used to diagnose or score a child.

11. Availability, changes, and suspension

Features may change, pause, or be unavailable because of maintenance, provider outages, safety controls, or legal requirements. Moonwish may restrict or suspend an account for suspected fraud, unsafe content, unauthorized photos, attempts to bypass moderation, material breach of these Terms, or risk to users or the service. Where reasonable, users may contact support to appeal an error.

12. Disclaimers and limitation of liability

To the extent permitted by applicable law, the service is provided on an “as available” basis without guarantees of uninterrupted operation or a particular creative result. Moonwish is not liable for indirect, incidental, special, consequential, or punitive damages, or loss caused by unauthorized sharing, user submissions, or third-party services. Any limitation applies only to the extent the law allows and does not exclude liability that cannot legally be excluded.

13. Operator, payments and governing terms

Moonwish is a brand run by one individual as an independent operator. It is not run by a company.

• The operator provides the Moonwish service: the website, the free character preview, and the generation and online delivery of digital storybooks. The operator also decides refund requests under the refund policy above.
• Payments are handled by Creem, which acts as the merchant of record for every purchase: you buy book credits from Creem, Creem appears on your receipt and bank statement, works out and collects any tax that applies, and processes approved refunds and payment disputes under its own terms.
• To reach the operator, use the support email in section 14. It is the contact for orders, refunds, privacy requests and these Terms.

These Terms do not choose a governing law or a court. Nothing in them limits the rights you have under the mandatory consumer-protection law of the country where you live. If something goes wrong, please contact support first so it can be put right.

If one provision is unenforceable, the remaining provisions continue to apply. Material updates will be posted with a new effective date.

13b. 经营者与适用条款（中文）

Moonwish 是由一名个人独立经营的品牌，不是由公司经营。

• 经营者提供 Moonwish 的服务：网站、免费角色预览，以及数字绘本的生成与在线交付；并依上文退款政策处理退款申请。
• 付款由 Creem 处理。Creem 是每一笔购买的记录商户（Merchant of Record）：你是向 Creem 购买绘本额度，收据和银行账单上显示的是 Creem；Creem 计算并代收适用的税费，并依其自身条款处理已批准的退款和付款争议。
• 联系经营者请使用第 14 节的客服邮箱；订单、退款、隐私请求和本条款相关问题都可以通过它联系。

本条款不指定适用法律或管辖法院。本条款的任何内容都不限制你依你所在国家或地区的强制性消费者保护法律享有的权利。遇到问题请先联系客服，我们会尽力解决。

如某一条款无法执行，其余条款继续有效。重大更新将以新的生效日期公布。
